The management of the Sahlaa Plus Application gives utmost care to protecting the privacy of its users and their personal and financial data, and undertakes to handle such data lawfully, transparently, and confidentially, in accordance with the provisions of the laws and regulations applicable in the Arab Republic of Egypt, particularly Personal Data Protection Law No. 151 of 2020, Anti-Cyber and Information Technology Crimes Law No. 175 of 2018, Mortgage Finance Law No. 148 of 2001, as amended, as well as the decisions and instructions issued by the competent regulatory authorities.

This Policy explains how users’ data is collected, used, shared, stored, and protected when using the Application or website. The user’s registration of an electronic account, use of the Application, or submission of any request through it shall constitute express and final consent to the provisions of this Policy and to the Application’s Terms and Conditions.

First: Scope of Application and Legal Nature

The Sahlaa Plus Application is a digital platform operating in the field of real estate financing brokerage and preliminary qualification of users seeking to obtain mortgage finance. It does so by receiving the data and documents uploaded by users, conducting preliminary assessments of such data and documents, and connecting users with financing entities or licensed institutions within the Arab Republic of Egypt.

The Application is not a bank, financing grantor, or mortgage finance institution, and it does not directly grant loans or credit facilities. Its role is limited to digital brokerage between users and banks/financing entities, and to providing supporting technical and organizational services that assist users’ applications.

The user acknowledges and agrees that approval, rejection, determination of the financing amount, term, conditions, or required collateral are entirely subject to the discretion of the competent financing entities in accordance with their internal policies and credit standards. The Application shall bear no liability for the decisions of such entities or for their results, legal effects, or financial consequences.

Second: Entered Data and Uploaded Documents

The Application retains the data entered by users and the documents uploaded by them. Such data may include personal, financial, and other data, depending on the nature of use, including the user’s full name, national ID number, residency number or passport number, date of birth, marital status, mobile phone number, email address, residential address, employer, job title, monthly or annual income, certificate of liabilities, bank loans, financing record, and certain credit indicators that may legally be disclosed and processed, for the purpose of reviewing the request submitted by the user, determining preliminary suitability, and any other required data.

Where a mortgage finance application is submitted or a real estate unit is offered, the entered data relating to the property itself shall be retained, including its type, license, location, estimated price, legal status, and related documents.

The Application also retains the location of the device used, operating system, Internet Protocol (IP) address, usage log, cookies, and geolocation data where the user has consented thereto.

Third: Data Retention

Entered data is retained and stored on the Application when the user registers, completes electronic forms, or uploads the required documents through the Application. Data may also be collected automatically during use of the Application through technical means designated to improve performance and increase the efficiency of the service provided to the user.

If the user’s personal and financial data is suitable for the purpose for which the user applied through the Application, the Application may contact the user and request further data based on a direct request from financing entities, official authorities, or service providers connected with the Application, within the limits that facilitate obtaining the required approvals whenever necessary.

The Application retains personal data and uploaded documents for as long as necessary to achieve the purposes for which they were collected or to fulfil the prescribed legal and regulatory obligations. After such purposes have ended, the data may be retained for an additional period if necessary for legal or accounting compliance purposes, or to defend against or initiate any judicial or regulatory proceedings.

Third Bis: Legal Basis for Data Processing

The user’s personal and financial data is processed on the basis of one or more legal bases prescribed under applicable laws and regulations, including:

·        The user’s express consent to the collection and processing of data.

·        Implementation of pre-contractual procedures or provision of the services requested by the user.

·        Fulfilment of legal and regulatory obligations imposed on the Application or the entities cooperating with it.

·        Protection of the legitimate interests of the Application or the user.

Fourth: Purposes of Data Use

The data entered into the Application is used to achieve purposes related to the nature of the Application’s activity, including creating and managing accounts, enabling successful login using the registered username and password, preliminarily reviewing financing applications submitted by users, presenting them to suitable financing entities, following up on application statuses with such entities, and contacting the user regarding any updates or required data and documents.

Entered data and uploaded documents may also be used to improve the quality of services provided through the Application, develop the relevant technical features, analyze usage patterns, provide technical support, and prevent fraud or misuse, including Know Your Customer (KYC) requirements and Anti-Money Laundering (AML) policies, as well as to send notifications and marketing offers where the user has consented thereto.

Fifth: Data Sharing and Disclosure

The Application may share the user’s data and uploaded documents, within necessary and lawful limits, with banks, mortgage finance companies, and licensed financing entities for the purpose of reviewing applications or completing the relevant procedures. Data may also be shared with providers of technical protection services and other services connected with the Application, identity verification companies, legal and financial advisors, and competent governmental, judicial, or regulatory authorities whenever this is a mandatory legal or executive obligation.

The Application further undertakes not to sell, trade, or exploit users’ personal or financial data for purposes not legally authorized. Disclosure of such data shall be limited to the entities necessary to provide the services, the entities legally authorized to receive it, or pursuant to orders or decisions issued by the competent judicial or regulatory authorities.

Sixth: Data Protection and Confidentiality

The Application takes reasonable technical and organizational measures to protect data and documents from unauthorized access, loss, destruction, alteration, or unlawful disclosure, including electronic protection systems, access-permission controls, secure retention procedures, and continuous technical monitoring.

However, by clicking the “I Agree” button, the user acknowledges and agrees that no electronic means of transferring or storing data can be guaranteed to be absolutely secure, and that technical risks and cyberattacks remain slight but inherent possibilities.

Seventh: Documents Uploaded by the User

The Application may request that the user upload the documents necessary to review the submitted application or verify the data, such as a national ID card, proof of income, bank statements, property ownership documents, sale or reservation contracts, and any other related documents.

By clicking the “I Agree” button, the user acknowledges the validity and integrity of the submitted documents and assumes full legal responsibility for any incorrect, forged, or misleading data or documents. The Application shall have no liability for any forgery presented before the competent authorities.

Eighth: Cookies and Similar Technologies

The Application may use cookies and similar technologies to improve the user experience, remember user preferences, analyze performance, improve the efficiency of technical services, and develop the content provided through the Application.

The user may control the settings of such files through the device or browser used, noting that disabling certain features may affect the efficiency, availability, or display of some services to the user.

Ninth: User Rights

Within the limits prescribed by law, the user has the right to request access to his/her personal and financial data and the documents uploaded by him/her, or to enter amendments, update them, or complete them. The user may also request deletion of the account or restriction of, or objection to, certain forms of processing where the legal conditions for doing so are met.

The user also has the right, within the legally prescribed limits, to request a copy of his/her personal data retained by the Application, or to request its correction, updating, completion, restriction of processing, objection to processing, transfer, or retrieval in a technically available format, in accordance with the applicable legal and regulatory procedures and controls.

Certain requests may be rejected if their execution conflicts with legal obligations, prejudices third-party rights, or affects the integrity of investigations or the legitimate interests of the Application.

Tenth: Marketing Communications and Notifications

The Application may send messages, notifications, introductory materials, or marketing or educational materials relating to the services provided or the products and offers connected with them, within the limits permitted by law and after obtaining the user’s consent where such consent is required.

The user may unsubscribe from such messages or object to receiving them at any time through the means available within the Application or through the announced communication channels, without affecting essential or legal notifications connected with use of the service or execution of the requests submitted by the user.

Eleventh: Children’s Privacy

The Application’s services are intended for persons who have reached eighteen (18) years of age and have full legal capacity. The Application does not intentionally collect data relating to persons under this age, and the Application may delete any account or data proven to violate this condition as soon as it becomes aware thereof.

Twelfth: External Links and Services

The Application may include links or services belonging to third parties, such as financing entities, partner websites, technical service providers, and others. Such parties are independent from the Application, and the Application shall not be responsible for their content, practices, or privacy policies. Users are advised to review such policies before dealing with them.

Thirteenth: Transfer of Data Outside the Arab Republic of Egypt

The Application or its contracted service providers may transfer, store, or process certain personal or financial data outside the Arab Republic of Egypt where required by the nature of operations, technical hosting, support services, or development services.

The Application undertakes to take appropriate legal, technical, and organizational measures to ensure an adequate level of protection for the transferred data, in accordance with Personal Data Protection Law No. 151 of 2020 and the regulations and decisions governing it.

Fourteenth: Amendments to the Policy

The Application reserves the right to amend or update this Policy at any time in line with legal, regulatory, operational, or technical developments. The amended version shall be published within the Application, and the user’s continued use of the service after publication shall be deemed acceptance of such amendments and updates.

Sixteenth: Acknowledgment of Consent

Use of the Application, creation of an account, submission of a financing request, or uploading of any documents through the Application shall be deemed an acknowledgment by the user that he/she has read the Privacy Policy, understood its contents, and agreed to its provisions and conditions, within the limits permitted by Egyptian law.
